The Independent Certifier is an impartial decision maker and issuer of certificates under the NZS 3910:2023 construction contract.
Under the 2023 version of the NZS 3910 construction contract, the role previously known as Engineer to Contract is split into two separate roles - the Contract Administrator (CA), and the Independent Certifier (IC).
Separating the roles better clarifies the responsibilities of each, and eliminates the tensions that can occur when a single person fulfils both roles. However, a single person can still perform both roles, and this is often more economically viable for smaller projects.
Impartial decision-making for successful project outcomes
The Independent Certifier - as the name suggests - acts independently of the parties to the contact. Although appointed by the Principal, the IC must remain impartial, making decisions fairly and independently. This includes valuing work and the contractor’s entitlements, assessing and valuing variations, and granting extensions of time.
The IC can also be called upon to make a decision when one can’t be reached between the Contract Administrator and the contractor.
Most importantly, the IC’s decisions must be in writing and include the reasons for the decision, improving transparency and facilitating better project outcomes.
